Terms of Service

These Terms of Service ("Terms") govern your access to and use of Take The L (the "App"), a social party game developed by Oliver Lay ("we", "us", or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. By creating an account, you represent and warrant that you meet this requirement.

4. User Content

Some game modes ("Prompt Battle") allow you to submit text responses that other players see. By submitting content you grant us a worldwide, non-exclusive, royalty-free license to display that content within the App for the purpose of running the game. You retain ownership of your content.

You agree that any content you submit complies with Section 3 above, and we reserve the right to remove content or accounts that violate these terms.

5. Purchases & Subscriptions

The core party game is free to play. Optional purchases — such as the Host Pass for hosting and cosmetic items — are billed through the Apple App Store or Google Play under their terms. Subscriptions renew automatically until cancelled; you can manage or cancel anytime through your app store account or in Settings. Except where required by law, payments are non-refundable. Prices may change with reasonable notice.

6. Intellectual Property

The App, its source code, art, music, game logic, prompts, and branding are owned by Oliver Lay and are protected by copyright and other intellectual-property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

You may delete your account at any time from Settings → "Delete Account". This permanently removes your data as described in our Privacy Policy.

We may suspend or terminate your account at our discretion if you violate these Terms or for any conduct that we determine, in our reasonable judgment, is harmful to other users or to us.

9. Disclaimers

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, secure from unauthorized access, or that lost data will be recovered.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Oliver Lay, his contractors, or his affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the App.

Our total cumulative liability for any claim arising from or related to the App will not exceed USD $20 (or the local currency equivalent), or the amount you have paid us in the 12 months before the claim, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

You agree to indemnify and hold harmless Oliver Lay from any claim, demand, loss, or damages arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Changes to the Service

We may modify or discontinue parts of the App at any time. We will give reasonable notice of significant changes when feasible, including changes to game rules or pricing.

13. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top and, where appropriate, notify you in the App. Continued use of the App after a change means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State where Oliver Lay resides (currently the State of New York, United States), without regard to conflict-of-law rules. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in that state, and you consent to personal jurisdiction there.

If you are a consumer residing in the EU/UK, this clause does not deprive you of the protections of mandatory local law.
